Definitions & General

“Owner” refers to Plant Hire Direct (PHD UK Limited), Company No. 05555629, registered at 20–22 High Street, Ruddington, Nottingham, NG11 6EH. “Hirer” means the individual or organisation hiring the equipment. “Plant” refers to all machinery or equipment supplied by the Owner under this agreement. These terms apply to all hires and override any terms from the Hirer unless agreed in writing. Acceptance—either by delivery, collection, or use—constitutes agreement.

Basis of Charging & Hire Period

Standard hire is weekly, with a minimum one-day hire as agreed. Charges commence at delivery and continue until the Plant is collected and confirmed by the Owner. Off-hire requests must be confirmed via reference number to be valid.

• Standby Days / Sub Days

1. Where the Plant remains on site and available for use but is not in active operation due to factors outside the Owner’s control—including but not limited to adverse weather, project delays, access issues, or other third-party causes—standby charges (“Sub Days”) may apply.
2. Sub Days will be charged at 20% of the weekly hire rate per calendar day, unless otherwise agreed in writing.
3. The Hirer must notify the Owner in writing prior to or on the day any Sub Day status is to apply. Failure to notify will result in full daily hire charges being applied.
4. Sub Days do not contribute to the fulfilment of any minimum hire period. During Sub Days, the Hirer remains fully responsible for the Plant’s security, insurance, and condition.
5. The Owner reserves the right to review Sub Day usage and may request collection or return of the Plant if it remains idle for a prolonged period.

Delivery

The Owner provides delivery service only—customers cannot collect. A mandatory fuel surcharge of £30 applies to every hire. Security deposit required

Optional Damage Waiver

Hirers may opt to include a Damage Waiver (optional insurance coverage) in their hire. Details of coverage and cost are provided at booking.

Cleaning Fees

All Plant must be returned in the same clean condition as provided. Cleaning charges will apply if the equipment is returned in an unclean state.

Payment Terms

Invoicing on a 30-day net basis for account holders. Late payments may incur interest or admin fees as per standard trade practices.

Loading, Unloading & Site Access

Hirer is responsible for loading and unloading, even if assisted by Owner’s staff. Hirer must ensure safe and suitable access and ground conditions. The Owner is not liable for surface damage.

Delivery Condition & Inspection

Hirer is deemed to accept Plant as delivered in good working order. Any defects or shortages must be reported within 24 hours (and followed up in writing within 72 hours). Hirer is liable for repair or replacement costs for lost, stolen, or unreturned Plant, based on current market or Owner’s valuation.

Maintenance & Safety

Hirer must keep Plant in good, clean, and safe condition. Breakdown must be reported immediately. Only Owner or authorised persons may conduct repairs, except puncture fixes, which the Hirer may undertake at their own expense.

Insurance & Incidents

Hirer must hold adequate Public Liability and Plant damage insurance. Proof may be requested before delivery. In case of an accident, the Hirer must notify Owner immediately (via phone), followed by written notice. Liability must not be admitted without Owner’s written consent.

Termination & Access

The Owner may terminate the hire and repossess Plant at any time without providing a reason. Hirer must grant reasonable access for inspection, maintenance, or repossession.

Indemnity & Liability Limitation

Hirer indemnifies the Owner against all claims (injury, property damage, etc.) arising from Plant use. Owner is not liable for indirect or consequential losses, including delays, breakdowns, or loss of output.

General Provisions

Any invalid or unenforceable provision does not invalidate the remainder of the agreement. Applicable law: England & Wales.

Delivery & Requirements

• Delivery only: All hires are delivered by Plant Hire Direct. Customer collection is not available under any circumstances.

• Delivery is not free: A delivery fee will always apply, and this will be confirmed at the time of booking.

• Two forms of ID are required for new Customers: New Customers require two forms of Identification to hire plant equipment if you are not a plant hire account holder. You’ll need to provide a driving licence or passport and a recent household utility bill (within the last three months) showing your name and current address.
